We previously shared with you information about the temporary changes to the law regarding Education Health and Care (EHC) plans during the Coronavirus pandemic, which was followed by a factsheet from Information, Advice and Support Manchester (IASM) explaining the changes in more detail.

On Friday last week, the 29th of May, the Secretary of State issued a notice to extend the temporary changes to the law on what provision has to be made currently for those with EHC plans. The amended DfE guidance was released shortly after, followed by an open letter from Minister Ford to “all children and young people with special educational needs and disabilities (SEND), their parents/carers and families, and others who support them”.

Changes to the original guidance include: cases in progress on 1 May 2020; annual reviews for those with EHC plans changing phase of education; actions following a tribunal ruling; and unchanged duties in relation to social care provision in plans.
